'Self-Assembly Products' means furniture delivered flat packed for assembly by the customer;

'Standard Home Furnishings' covers all Products such as cushions, lighting and wallpaper but excludes Furniture, Upholstery and Made-To-Measure

'Working Day(s)' means any day other than a Saturday, Sunday or any day which is a public holiday;

'we', 'us', 'our' means Eden Rose Lifestyle;

'you', 'your' means the customer.

 

2. Limited Licence and Restrictions

You acknowledge and agree that the material and content contained on the Website is made available to you for your personal and non-commercial use and that you may only download such material and content for the purpose of using the Website to a single personal computer. Furthermore you acknowledge and agree that any other use of the material and content of the Website is strictly prohibited and you agree that it is strictly prohibited to (or to assist or facilitate any third party to) copy, reproduce, transmit, modify, publish, display, distribute, commercially exploit or create derivative works of material and/or content from the Website without our written permission and is a violation of our intellectual property rights.

 

3. Basis of Sale

All orders that you place on the Website will be subject to acceptance in accordance with these terms and conditions.

Please follow the simple onscreen instructions taking you through the process of placing an order on the website. You place the order for your products by pressing "Complete Purchase" on the "Purchase page", in doing so you offer to buy the Goods at the prices indicated as well as any applicable delivery charges.

 

An order acknowledgement email will be sent to you detailing the products you have ordered. Please note that this email is merely an acknowledgement of your order and not an acceptance or confirmation of your order by Eden Rose Lifestyle.

 

Except for all orders of Furniture, Upholstery and/or Made-to-Measure products, the acceptance of your order and the completion of the contract between you and us will take place on dispatch of the products unless we have notified you that we do not accept your order or you have cancelled it. If you have ordered Furniture, Upholstery and/or Made-to-Measure products the acceptance of your order and the completion of the contract between you and us will occur when you receive a confirmatory letter from us unless we have notified you that we do not accept your order or you have cancelled it. Once we have accepted your order it becomes binding, subject to your rights of cancellation. Non-acceptance of an order by us will occur if: the ordered product is out of stock or unavailable; we identify a pricing or product description error; or we are unable to obtain authorisation for your payment.

 

We reserve the right to withdraw any Products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any Product from this Website whether or not that Product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

 

To be eligible to purchase Products on this Website and lawfully enter into and form contracts on this Website under English law you must: be over 18 years of age; register by providing your real name, phone number, email address, payment details and other requested information; provide a valid delivery address in the United Kingdom; (Please note that PO box numbers, hotels and temporary accommodation addresses are not acceptable); and possess a valid credit or debit card issued by a bank acceptable to us.

 

Please note that any acceptance of an order placed from outside the United Kingdom is not valid.

 

4. Cancellations, Returns and Refunds

Upholstery, Furniture and Made-To-Measure Products If you need to amend or cancel your order for Upholstery, Furniture or Made-to-Measure Products you are entitled to do so at any time up to 48 hours after you have placed your order, by contacting Eden Rose Lifestyle.

 

If you amend or cancel your order more than 48 hours after you placed it, we reserve the right to charge you any costs we incur in relation to your order, however this shall not be more than 25% of the total price of the ordered products.

 

Furniture ordered via Distance Communication may be cancelled at any time up to 7 Working Days commencing from the day after receipt of the Product. For example, if delivery occurs on Monday, the 7 Working Day period commences on Tuesday. Please note that no cancellation charges or costs are applicable if the order is cancelled within this period but the return costs will be borne by you (see below for further details).

 

5. Returns

Where you are returning faulty Products, you should return them to us by one of the methods set out below, with proof of purchase (receipt or dispatch notes), unused and in the condition in which you receive them.

In Store: All Products can be returned in person to Eden Rose Lifestyle, Chepstow. By Post: Alternatively you can return Standard Home Furnishings or Fashion Items by post to:

If you return Products by post, please ensure you package and label them properly so that they are not lost or damaged in transit. We recommend you retain some proof of postage in the event that the Products go missing, as Products remain your responsibility and property until we receive them.

 

If you believe any of our Products to be of an unsatisfactory quality please immediately contact us and treat your Product with the utmost care. Nothing mentioned in these terms and conditions affects your statutory rights in the unlikely event that the goods do not meet a standard required by law.

Essential Checks Before Ordering

It is your responsibility to ensure that the Upholstery and Furniture Products you have ordered will fit into your home, and that there is sufficient access for our delivery lorry to reach the delivery address.

 

Essential Checks on Delivery

An adult must be available at the address to carefully check the unwrapped product, sign and acknowledge receipt in a safe and satisfactory condition. Please report any defects immediately upon delivery to Customer Services. For Self-Assembly Products, you are only required to sign for the packaged goods received.

 

Delivery Charges and Carriers

Eden Rose Lifestyle only delivers to the following UK territories: Mainland UK, Northern Ireland, the Isle of Wight and the Channel Islands (please note that we do not deliver Furniture to the Channel Islands).

 

Important Delivery Information

Deliveries requiring special arrangements can sometimes be made but will be at an additional cost to you.

 

Delivery Times

Delivery dates and weeks are not guaranteed but we will do our utmost to ensure goods are delivered within the stated date or soon afterwards.

 

We shall not be liable for delays or failures in delivery caused by a failure to gain access to the delivery address on the agreed delivery date or because of other circumstances beyond our reasonable control.

 

Specific delivery times and days cannot be agreed at any time in the order process.

 

Delivery of Upholstery and Furniture

The delivery crew will not attempt delivery if there are health and safety issues or where damage to your property may occur nor will they remove doors and windows.

 

If no one is available to accept delivery, we will charge you £50 per single item re-delivered and £75 total for more than one item re-delivered at the same time.

 

Where the item/s ordered will not fit into your home, in addition to any cancellation fee incurred, we will charge you a non-refundable removal fee of £50 per single item and £75 total for more than one item.

 

7. Risk & Property

We carry the risk of loss or damage to the Products until you receive them. The Property of the Products will pass to you when you have received them and have paid us in full. Until payment has been made in full we may ask you to return the Products to us at any time. If you return the Products to us for any reason, they will become our property and be at our risk from the time at which we receive them.

 

8. Prices

All prices are in Pounds Sterling inclusive of VAT at the current rates but excluding delivery charges.

 

All reasonable care is taken to ensure that the prices shown are correct at the time of publication including VAT. If an error has been made, we or you may cancel the order in relation to some or all of the Goods as indicated under "Cancellation".

 

It may be necessary to raise our prices in certain circumstances, e.g. if component costs increase or currency conversions change materially.

 

The price for the Products you order will be the price confirmed to you soon after you place your order. If this varies from any quoted price, we will contact you to check that you still wish to proceed.

 

9. Payment Methods

You may pay using your Visa, MasterCard, Switch and American Express.

 

You confirm that the credit or debit card that is being used is yours.

 

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

We will take all reasonable care to ensure that all details, descriptions and prices of Products appearing on the Website are correct at the time when the relevant information was uploaded onto the system. Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a Product until your order is accepted in accordance with our Order acceptance policy. Please note that in the event that an error is identified non-acceptance of an order by us may occur, subject to your statutory rights.

You confirm that, in agreeing to accept these terms and conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these terms and conditions

 

18. Severance

If any provision contained in these terms and conditions is considered by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not effect the other terms and conditions which shall remain in full force and effect.
